TERMS OF SERVICE

2.1 You must be at least 18 years old to use the App.

2.2 Do not upload images of minors or anyone for whom you do not have explicit permission.

2.3 You agree to use the App only for lawful purposes and not to upload illegal, obscene, or infringing content.

3.1 Your uploaded images are used solely to generate your personalized color analysis results using AI models, including third-party APIs such as FAL.ai.

3.2 Images are processed as needed for your results and, unless you explicitly opt in to retain your data for future sessions, will be deleted from our systems as soon as reasonably possible after your results are delivered (typically within 24 hours).

3.3 If you choose to retain your images and model for future sessions, you may request deletion at any time by contacting trycolorwhee@gmail.com. Deletion will be completed as soon as reasonably possible.

3.4 We do not use your images for any other purpose, nor do we sell or share them, except as required to provide the service through trusted third-party processors.

4.1 Payment processing is handled by third-party providers (e.g., Stripe, PayPal). We do not store your payment details.

4.2 Image processing is performed using third-party APIs (e.g., FAL.ai). These providers may process data in accordance with their own privacy policies, and may use anonymized or aggregated data for analytics, research, or service improvement. Please review their privacy policies for more information.

5.1 Data is transmitted over secure (HTTPS) connections.

5.2 We make reasonable efforts to protect your data, but as a solo founder with limited resources, full legal and regulatory compliance (such as GDPR, CCPA, etc.) cannot be guaranteed at this stage.

5.3 By using the App, you acknowledge and accept these limitations and agree to use the service at your own risk. Please do not upload images you consider highly sensitive.

6.1 You agree to pay all applicable fees for paid features.

6.2 All payments are processed securely by third-party providers. We do not store your payment information.

6.3 All sales are final. Refunds are provided only at our discretion or where required by law.

7.1 You retain ownership of your uploaded images and generated results.

7.2 We retain rights to the App, software, and website content.

7.3 You grant us a limited license to use your images solely for providing the service, which terminates when your images are deleted.

8.1 The App is provided "as is" and "as available" with no warranties or guarantees of any kind. We do not guarantee the accuracy, completeness, or suitability of analysis results.

8.2 To the fullest extent permitted by law, we disclaim liability for any indirect, incidental, or consequential damages arising from your use of the App.

8.3 Our total liability to you is limited to the amount you paid for the service.

10.1 You may request deletion of your images and data at any time by contacting trycolorwhee@gmail.com. Deletion will be completed as soon as reasonably possible.

10.2 If you are located in a jurisdiction with specific privacy rights (such as the EU or California), please contact us to exercise your rights. We will make reasonable efforts to accommodate your request within our technical and resource limitations.
